ELECTRIC BICYCLES, MOTORIZED SCOOTERS, AND MOTORIZED MOBILITY DEVICES

Sec.14-3 - Ordinance No. 20-26-A was passed and adopted on June 23, 2026.

(a) Definitions. As used in this section, the following words and terms shall have the meanings provided.

Electric Bicycle: a bicycle or tricycle equipped with fully operable pedals, a seat or saddle for the use of the rider, and an electric motor of less than 750 watts which meets the requirements of one of the following three classifications:

"Class 1 electric bicycle" means an electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the electric bicycle reaches the speed of 20 miles per hour.

"Class 2 electric bicycle" means an electric bicycle equipped with a motor that may be used exclusively to propel the electric bicycle and that ceases to provide assistance when the electric bicycle reaches the speed of 20 miles per hour.

"Class 3 electric bicycle" means an electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the electric bicycle reaches the speed of 28 miles per hour.

Motorized Mobility Device: Any personal device that is powered by a motor with or without a seat or saddle for the use of the rider, which is designed to travel on one or more wheels including, but not limited to, boards. skateboards. skates. hoverboards. or other similar personal mobility devices. This definition shall not include a motorized wheelchair or similar mobility device used for mobility purposes by persons with disabilities.

Motorized Scooter. Any vehicle or micromobility device that is powered by a motor with or without a seat or saddle for the use of the rider. which is designed to travel on not more than three wheels. and which is not capable of propelling the vehicle at a speed greater than 20 miles per hour on level ground. The term does not include an electric bicycle.

Public Park: Any park. recreational. athletic. or playground area or facility administered by the City's Leisure Services Department and maintained as a public park or recreational facility. whether or not such areas have been formally dedicated to such purpose.

Recreational Facility: Any area or facility administered by the City's Leisure Services Department and maintained for active or passive recreational activities by the general public. including but not limited to golf courses. multipurpose centers. and public plazas designed primarily for pedestrian traffic.

(b) Notwithstanding any other provision of this Code. no person shall drive or operate any electric bicycle. motorized scooter, or motorized mobility device on any area within a public park or recreational facility, except for park roads and designated parking areas for parking purposes only. When operating such devices on park roads. no person shall drive or operate such devices at a speed exceeding 15 miles per hour. The operator of such devices shall obey all safety rules and regulations set forth by state law. and the operator shall respect the safety and security of other park users.

(c) The prohibitions contained in this Section shall not apply to motorized mobility devices used by disabled persons or park personnel. or as otherwise authorized by the City Manager.

(d) Violations. Violations of this Section may be enforced by park personnel, issuance of a warning or citation by the City's police department, or by any other means permitted by law.
